despite とほぼ同義だが、極めてフォーマルで法律文書・契約・硬い論説に多い。最大の特徴は語順の自由さで、名詞の前（notwithstanding the cost）にも後ろ（the cost notwithstanding）にも置け、さらに副詞として単独でも使える。日常会話では despite を使うのが普通。語源は not + withstanding（逆らって立つこと）の否定。
語源・由来
not + withstanding（with=逆らって + stand=立つ、の現在分詞）で「逆らって立つことなく＝妨げにならず」が原義。ラテン語 non obstante の翻訳借用。
